Chain Reaction Collision Involving 20 Vehicles Kills 2

According to KOAT 7, a devastating chain reaction collision resulted in two fatalities earlier this month. The incident occurred on I-25 near Romeroville, where freezing temperatures had left ice on the roads.

Traffic jam in Los Angeles

New Mexico State Police claim the chain reaction began when a vehicle traveling north skidded out of its lane, crashing into the median. The driver of an approaching tractor-trailer tried to avoid the wreckage but was unable to decelerate in time.

The truck and its load swung across the highway, prompting subsequent collisions among the vehicles behind it. The pileup involved 20 vehicles in total including three semi-trailers.

At least 30 individuals who sustained injuries went to Alta Vista Regional Hospital for treatment. This prompted the hospital to enact their emergency preparedness plan, which called in additional staff members to handle the influx of patients. Tragically, two individuals in separate vehicles sustained fatal injuries.

The New Mexico Department of Transportation applies salt and sand regularly in anticipation of icy conditions. Authorities claim they had been preparing the roads the night before the incident as a preventive measure.

Unfortunately, even if you exercise caution when road conditions are poor, you cannot rely on other motorists to do the same. If you lost a loved one in a collision with a reckless driver this winter, turn to The Law Office of Brian K. Branch.

What Is the Statute of Limitations on Wrongful Death Claims in New Mexico?

If you lose a family member in a preventable crash, you typically have three years from the date of death to file a wrongful death lawsuit against the liable motorist. Since some factors can effectively “pause” the clock, though, it is wise to seek legal counsel as soon as you decide to file a claim, regardless of how much time has passed.

Who Can File a Wrongful Death Lawsuit in New Mexico?

Every state has restrictions on who may file a suit following the wrongful death of a loved one and on which family members may receive any resulting compensation. In New Mexico, for example, the personal representative of the deceased’s estate must file the claim.

If the deceased had a will, he or she likely named a personal representative. If the named individual is unable to serve or the accident victim did not have an estate plan, the court will appoint someone to act as the representative. Any compensation that results from the suit will go to the surviving spouse, children, grandchildren, parents, or siblings, depending on the circumstances.

Losing a loved one in an avoidable accident is devastating, but surviving family members can achieve some sense of closure by holding the liable party accountable. If you want to file a wrongful death claim, contact The Law Office of Brian K. Branch today.
